A recent report by Canada’s victims of crime advocate sheds light on the challenges faced by survivors of sexual violence within the criminal justice system. The report, titled “Rethinking Justice for Survivors of Sexual Violence: A Systemic Investigation,” highlights issues such as disbelief in allegations, frequent delays or dismissals of cases, and lack of support for victims.
Benjamin Roebuck, the federal ombudsperson for victims of crime, conducted the extensive report, which involved over 3,000 interviews, surveys, and case reviews since March 2024. The investigation focuses on the treatment of sexual violence victims in the justice system, including belief in their allegations, available resources, and the impact of factors like vulnerability and location on their experiences.
According to Roebuck, the justice system’s credibility is at stake as police officers and Crown attorneys often discourage survivors from reporting or pursuing charges due to the prevailing harm and lack of trust in the administration of justice. The report emphasizes systemic issues that need addressing to empower victims to come forward without fear of re-traumatization.
The report presents 43 recommendations across 10 categories to enhance outcomes for survivors of sexual violence. Key recommendations include thorough investigation of reported sexual violence allegations, tailored training for law enforcement and courts on the needs of assault survivors, and the cessation of practices like “KGB statements” that undermine victim credibility.
Furthermore, the report calls for improved access to justice for Indigenous communities, implementation of calls for justice from the National Inquiry into Missing and Murdered Indigenous Women and Girls, and reforms to address delays in court proceedings. It advocates for fair cross-examinations, safeguarding victims’ therapeutic records, and enhancing support services for sexual assault survivors in the community.
By advocating for systemic changes and greater transparency in the criminal justice system, the report aims to ensure better protection and support for survivors of sexual violence. It underscores the importance of addressing barriers and inequalities to create a more just and responsive system for all victims.
