“Vancouver tenants resist eviction threats over Facebook group”

A cluster of Vancouver tenants is pushing back against eviction threats stemming from their involvement in a private Facebook group for renters. Residents of The Yarrow apartment complex on Kootenay Street in East Vancouver claim a notice was affixed to their doors by Realstar Group, the entity managing the building. The prominently highlighted message in all capital letters states, “WARNING BREACH OF TENANCY AGREEMENT.”

The letter, specifically targeting members of the Facebook group Yarrow Residential Hub, warns against sharing private conversations and encouraging fellow tenants to lodge complaints, deeming it a serious violation of the Tenancy Agreement and Residential Tenancy Act. It suggests that certain group comments could be considered as libel, ending with a stark warning of potential tenancy termination for any repeat offenses.

Realstar Group, a Toronto-based company with assets exceeding $9 billion, declined to provide interviews to CBC News but issued a statement acknowledging the concerns raised by residents regarding the letter. The company expressed a commitment to fostering open dialogue with tenants while ensuring a safe and respectful working environment for its staff. Subsequently, Realstar issued an apology to residents for the distress caused by the initial notice.

Prior to the company’s apology, a group of ten tenants, identifying themselves as Concerned Tenants of The Yarrow, penned a response to Realstar challenging the accusations in the letter as baseless and distressing. The group demanded an end to what they perceived as threatening or harassing emails in response to service requests and urged Realstar to refrain from surveilling tenant communications, both online and offline.

According to Mariah Javadi of the Vancouver Tenants Union, the intimidating tone of the Realstar letter is viewed as an attempt to suppress tenant discussions within the group. Legal experts, such as Robert Patterson of the Tenant Resource and Advisory Centre (TRAC), cast doubt on the company’s grounds for eviction under the Residential Tenancy Act, noting that tenants have the right to communicate and share experiences freely within the bounds of the law.

The Yarrow Residential Hub Facebook group, established prior to Realstar’s acquisition of The Yarrow, serves as a platform for approximately 100 members to connect with neighbors, discuss building-related matters, and engage in community activities. Instances of landlords accusing tenants of libel are on the rise, with legal advice emphasizing the importance of factual communication to mitigate potential legal risks.
