Legal Action Seeks Justice for Ontario School Abuse

Paul Grimston, now 69 years old and residing in a motorhome on Vancouver Island, continues to grapple with the profound impact of the abuse he endured at an Ontario government-run detention center during his childhood, despite the passage of over 50 years and a distance of 3,500 kilometers.

Recalling the torment he faced, Grimston expressed, “The memories are vivid and haunt me daily. I have witnessed and endured unimaginable horrors.”

Having initiated a class-action lawsuit against the province in December 2017, Grimston and fellow survivors from the training schools are still awaiting resolution, seeking both an apology and compensation.

Legal Action Alleges Pervasive Abuse

The class-action lawsuit, spearheaded by Koskie Minsky LLP in Toronto, outlines a grim environment within the training schools where children were subjected to degrading treatment as a norm, with rampant physical, sexual, and psychological abuse prevailing.

The lawsuit seeks $600 million on behalf of approximately 21,000 children who were sent to these schools between January 1, 1953, and April 2, 1984.

While the Ontario Ministry of the Attorney General refrained from commenting on the ongoing lawsuit, their statement of defense denies any liability or wrongdoing, emphasizing that the claims remain unproven in court.

Notably, thousands of children were enrolled in these institutions for various reasons such as being labeled as “unmanageable,” facing academic challenges, or being accused of minor offenses like vandalism.

According to Grimston, after being deemed too troublesome for his single mother to handle, he was placed in the custody of the Ontario Training Schools, an experience that left him with enduring nightmares and emotional scars.

Recounting his time at Brookside School in Cobourg, Grimston detailed the physical and emotional mistreatment he endured at the hands of the staff.

The lasting repercussions of the trauma experienced by the students, including difficulties in forming trusting relationships and sustaining employment, are highlighted in the legal documentation.

Grimston revealed that his aspirations of pursuing a career as a veterinarian were derailed due to the trauma he underwent, a fate shared by many of his peers who struggled with addiction, incarceration, or tragic outcomes like suicide and drug overdoses.

Andrew Eckart, a legal expert from the University of Windsor’s Class Action Clinic, noted that delays in settling lawsuits of this nature are not uncommon and can stretch over five to ten years, attributing the prolonged duration to the extensive documentation and complexities involved in cases of institutional abuse.

Adam Tanel, a partner at Koskie Minsky LPP, emphasized the rigorous process involved in handling such extensive legal actions, underscoring the necessity for thoroughness over expediency in achieving justice for the claimants.

It is highlighted that the shortage of judges within the civil justice system has contributed to the delays in resolving cases like the one involving the Ontario Training Schools, causing frustration among plaintiffs awaiting closure.

Despite the government’s efforts to address judicial shortages and backlogs, concerns persist regarding the inadequacy of resources within the legal system that hinder the timely resolution of cases.
