A dispute between comedian Stephen Colbert and the network broadcasting his late-night show is shedding light on a long-standing broadcasting regulation called the equal time rule. During a recent episode of “The Late Show with Stephen Colbert,” the host revealed that CBS’s legal team prohibited him from featuring an interview with Texas Democrat James Talarico, a Senate candidate. Colbert humorously addressed the conflict on air after being instructed not to mention the ban on Talarico’s appearance.

CBS countered Colbert’s account, explaining that they had simply advised on the potential application of the FCC’s equal-time rule to the broadcast. The equal time rule, a provision under the Communications Act of 1934, mandates that all election candidates receive equal airtime on broadcast programs to prevent bias or favoritism.
