The British Columbia government has announced the implementation of new regulations that restrict the circumstances under which an employer can request a sick note. This initiative aims to alleviate the burden on doctors from issuing sick notes and prevent the further spread of illness by sick individuals.
According to the government’s statement, the updated employment standards now prohibit employers from requesting a sick note for the first two health-related absences lasting up to five consecutive days within a year. Health Minister Josie Osborne emphasized that these new rules, effective as of Wednesday, will enable sick individuals to stay home and recuperate without the unnecessary requirement of a sick note, thereby reducing the administrative workload on physicians.
Dr. Lisa Gaede, a family physician and representative of Doctors of B.C., highlighted the significant strain that sick notes impose on healthcare providers and welcomed the change, which will allow them to allocate more time to patients in need of medical assistance.
The decision to implement these changes stemmed from feedback received from healthcare providers, who pointed out that scientific research indicates most minor illnesses, such as colds or the flu, typically resolve within five days. Labour Minister Jennifer Whiteside emphasized that individuals suffering from illnesses like the flu should not be compelled to visit their doctor solely to obtain a sick note, as such unnecessary medical appointments not only divert resources from those genuinely in need but also pose a risk of further infection spread.
The Canadian Medical Association estimated that approximately 1.6 million sick notes were issued by B.C. doctors last year. The government clarified that health-related absences covered under the new regulations encompass situations where an employee or their immediate family member is unwell or injured.
The government acknowledged the widespread demand from healthcare providers across the province for relief from administrative tasks, including the issuance of sick notes, which detract from patient care. The elimination of sick note requirements was a significant commitment in the B.C. NDP’s electoral campaign last year. The province introduced Bill 11 in April to amend the Employment Standards Act regarding sick notes and pledged to implement these changes ahead of the upcoming respiratory illness season.
