“N.W.T. SPCA Calls for Recognition of Pets as Sentient Beings”

The N.W.T. Society for the Prevention of Cruelty to Animals (SPCA) is urging the territorial government to recognize domestic animals as sentient beings rather than mere property under the law. The current Dog Act in the Northwest Territories designates dogs as the property of their owners, allowing for actions such as selling or giving away a dog if the owner is taken into custody.

The SPCA has received ongoing feedback from both tourists and residents expressing concerns about the welfare of animals in the region. They argue that the existing legislation restricts authorities from intervening effectively, as it may not adequately address complex animal welfare situations beyond basic standards like food, water, and shelter.

Jennifer Friedman, an animal welfare lawyer from Toronto, notes that pets are commonly treated as property in various Canadian jurisdictions, including Ontario. While some provinces, like British Columbia, are beginning to broaden the criteria for determining the fate of pets in family disputes, Friedman emphasizes the importance of not just having clear laws but ensuring their enforcement.

The Department of Municipal and Community Affairs, responsible for administering the Dog Act, stated that there are currently no plans to amend the legislation. The Minister for Municipal and Community Affairs, Vince McKay, acknowledges complaints about the act but emphasizes that municipalities have the primary responsibility for managing how animals are handled within their jurisdictions. McKay mentions the possibility of future reviews of the Dog Act but highlights the need for a balanced approach that considers both community needs and animal protection.
